Terms & Conditions

1. Definitions

• “Pickle” / “Platform” means the Pickle website, web application, APIs, and any associated services operated by us.
• “Creator” means an individual who registers as a content creator to build a profile, showcase content, and participate in brand collaborations.
• “Brand” means a business or individual who registers to discover creators and run collaboration campaigns.
• “User” means any Creator, Brand, or visitor who accesses the Platform.
• “Content” means any text, images, videos, links, bio, profile data, or other material submitted to or displayed on the Platform.
• “Campaign” means a brand-initiated collaboration opportunity posted on the Platform.

2. Eligibility & Accounts

You must be at least 18 years of age to use the Platform. By using Pickle, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into a binding agreement.
• All registration information you provide is accurate, current, and complete.
• You will maintain the accuracy of such information and promptly update it when necessary.
• You are not barred from using the Platform under applicable law.

You are solely responsible for maintaining the confidentiality of your login credentials. You agree to notify us immediately at contact@pickle.live of any unauthorised use of your account. Pickle shall not be liable for any loss or damage arising from your failure to safeguard your credentials.

We reserve the right to refuse account registration or revoke access at our sole discretion, without notice or explanation.

3. Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

• Use the Platform in any way that violates applicable local, national, or international law or regulation.
• Attempt to gain unauthorised access to any part of the Platform, its servers, or any third-party systems connected to it.
• Transmit any unsolicited or unauthorised advertising or promotional material.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive source code from the Platform.
• Use automated bots, scrapers, or similar tools to access or collect data from the Platform without our prior written consent.

4. Creator Terms

As a Creator, you agree to the following:

• Profile Accuracy. You will keep your profile information — including name, bio, categories, social media handles, follower counts, and audience demographics — accurate and up to date.
• Content Ownership. You confirm that you own or have all necessary rights, licences, consents, and permissions to the Content you post.
• Platform Showcase. By opting in to the Creator Showcase feature, you grant Pickle the right to display your profile, name (first name), avatar, location, and category tags on the public Creators page and in marketing materials.
• Campaign Participation. Participation in campaigns is voluntary. Once you accept a campaign, you are bound by its specific terms agreed with the Brand. Pickle is not a party to that agreement and bears no liability for disputes arising from it.
• Disclosure. You are solely responsible for complying with all applicable advertising disclosure laws (e.g., ASA, FTC guidelines) when publishing sponsored content.
• Instagram Connection. By connecting your Instagram account, you authorise Pickle to access your Instagram profile data, media, follower count, and engagement metrics in accordance with Meta's Platform Terms, and you agree to our use of that data as described in these Terms.

5. Brand Terms

As a Brand, you agree to:

• Truthful Representation. Provide accurate company information, campaign briefs, and deliverable expectations.
• Respectful Conduct. Treat Creators professionally and honour agreed deliverables and payment terms.
• Creator Access. Access to Creator profiles beyond the publicly available pages is subject to your account status and any applicable subscription or access tier. Pickle may modify access tiers at any time.
• Campaign Responsibility. You are solely responsible for ensuring your campaigns comply with all applicable advertising, consumer protection, and platform-specific laws and policies.
• No Circumvention. You must not contact Creators discovered through Pickle to conduct collaborations outside the Platform in order to avoid applicable fees or processes, during any period in which you have active access to the Platform.

6. Content & Licence

By submitting any Content to Pickle, you grant us a worldwide, royalty-free, non-exclusive, perpetual, irrevocable, sub-licensable licence to use, reproduce, modify, adapt, publish, translate, distribute, publicly perform, and display such Content in any and all media formats, for the purposes of:

• Operating and improving the Platform.
• Marketing and promoting Pickle, including displaying your name (first name), avatar, and content snippets in advertisements, social media posts, press materials, and investor presentations.
• Providing our services to Brands and other Users.
• Generating aggregated, anonymised insights and data products.

You retain ownership of your Content. You represent that your Content does not infringe any third-party rights. We reserve the right — but are not obligated — to remove any Content that, in our sole judgement, violates these Terms or is otherwise objectionable.

7. Data We Collect

To provide and improve our services, we collect the following categories of data:

8. How We Use Your Data

We use the data we collect for the following purposes:

• Service Delivery. To create and manage your account, operate profile pages, display collections and posts, facilitate creator-brand matchmaking, and run campaigns.
• Creator Discovery. To display Creator profiles, photos, categories, and stats to Brands and visitors using our platform, including the public Creators Showcase page.
• Platform Marketing. To showcase real Creators (with their first name and profile photo) in platform marketing materials, advertisements, social media, and promotional content in order to build trust in the Pickle brand. This includes use of your avatar and first name where you have opted in to the Showcase feature, or where your profile is publicly accessible.
• Instagram DM Automation. To detect trigger keywords in comments, check follower status, and send automated Instagram Direct Messages on your behalf using the configuration you set up.
• Analytics. To provide you with click analytics on your links and posts, and to generate platform-wide usage insights for internal analysis and product development.
• Communications. To send you transactional emails (account verification, password reset, campaign notifications, welcome emails) and, where you have opted in, marketing communications.
• Security & Fraud Prevention. To detect and prevent unauthorised access, abuse, fraud, and policy violations.
• Legal Compliance. To comply with applicable laws, respond to lawful requests from authorities, and enforce these Terms.
• Product Improvement. To analyse aggregated and anonymised data to understand usage patterns and improve Platform features.
• Investor & Business Development. To use aggregated metrics and, where consented, individual Creator stats in presentations to investors and business partners.

9. Instagram & Third-Party Integrations

When you connect a third-party account (such as Instagram) to the Platform:

• You authorise Pickle to access, store, and use data from that account as permitted by the respective platform’s API policies and as described in these Terms.
• You confirm that you have the right to authorise such access, and that doing so does not violate the third-party platform’s terms of service.
• Pickle will store your access tokens securely. These tokens allow us to fetch your media, follower data, and other permitted data on your behalf. We will use this data to power your profile, analytics, and DM automation features.
• We take periodic snapshots of your Instagram data for historical analytics and trend tracking. These snapshots are retained per our data retention policy.
• If you disconnect your Instagram integration, we will cease fetching new data; however, previously collected data may be retained for operational and analytical purposes for up to 12 months unless you submit a deletion request.
• Pickle is not responsible for changes to third-party APIs that may affect the availability or accuracy of integrated features.

10. DM Automation

Pickle’s DM automation features allow you to configure automated responses to Instagram comments and direct messages. By using these features, you acknowledge and agree that:

• You are solely responsible for the content of automated messages, compliance with applicable laws, and adherence to Meta/Instagram’s policies.
• Pickle stores comment data, commenter Instagram user IDs, DM delivery logs, and related automation configuration data in order to operate the feature and provide you with reporting.
• We may use aggregated, anonymised DM performance data for platform analytics and product improvement.
• You must not use DM automation to send spam, misleading messages, or content that violates Meta’s platform policies or applicable law.
• Pickle reserves the right to disable your DM automation configuration if we detect misuse or receive complaints.

11. Analytics & Tracking

The Platform tracks link clicks and profile views in order to provide analytics to Creators and Brands. This tracking data includes:

• IP addresses and hashed IP identifiers of visitors clicking your links.
• Approximate geolocation (country and city level) derived from IP address.
• Device type, operating system, and browser of the visitor.
• HTTP referrer and UTM tracking parameters.
• Proxy, VPN, and Tor detection flags.

By using the Platform, you acknowledge that this data is collected about visitors to your profile or content. You are responsible for informing your audience of any tracking that may occur as required by applicable law (e.g., GDPR cookie notice requirements). Pickle uses this data to power your analytics dashboard and for internal platform performance analysis.

We may use third-party analytics tools (including Google Analytics) to track Platform usage. Please refer to our Privacy Policy for more detail.

12. Creator Showcase

The Creator Showcase is a public-facing page on the Platform that features selected Creators to help Brands discover talent. By opting in to the Showcase feature via your profile settings:

• You grant Pickle permission to display your first name, profile photo, location (city/state/country), and content categories on the public Creators page.
• You grant Pickle the right to use the same information in platform marketing materials — including but not limited to advertisements, social media posts, email campaigns, and pitch decks — to promote the platform.
• You understand that your profile photo and first name may be seen by any member of the public or any registered Brand visiting the Platform.
• You may withdraw consent at any time by deselecting the Showcase option in your profile settings. Removal from the public page will take effect within 24 hours, but previously published marketing materials may continue to display your information.

Profiles selected for featured placement (marked as “Hero” by our admin team) may receive additional promotion at our discretion.

13. Payments & Fees

Any fees, subscription plans, or transaction charges applicable to your use of the Platform will be communicated to you separately and may be updated from time to time. By subscribing to a paid plan or paying for a service, you agree to the pricing and payment terms presented at the time of purchase.

• All fees are stated in Indian Rupees (INR) unless otherwise specified and are inclusive of applicable taxes where stated.
• Subscription fees are generally non-refundable except as required by applicable law or as explicitly stated in a specific plan’s terms.
• Pickle is not responsible for payment disputes between Creators and Brands arising from collaboration arrangements facilitated through the Platform. Such disputes are solely between the parties involved.
• We reserve the right to modify pricing with reasonable notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.

14. Intellectual Property

The Pickle name, logo, brand identity, design system, software code, and all Platform features are the exclusive intellectual property of Pickle and its licensors. You may not:

• Copy, reproduce, modify, or create derivative works from any Pickle branding or platform elements.
• Use the Pickle name or logo without prior written permission.
• Frame or mirror any part of the Platform on any other website or application.

You retain ownership of Content you submit. Nothing in these Terms transfers ownership of your Content to Pickle beyond the licence granted in Section 6.

15. Prohibited Conduct

The following conduct is strictly prohibited on the Platform:

• Posting false, misleading, or fraudulent content or claims about your follower counts, engagement, or audience demographics.
• Harassing, threatening, or abusing other Users.
• Uploading content that infringes any copyright, trademark, privacy, or other intellectual property rights.
• Distributing malware, viruses, or any other harmful code.
• Attempting to circumvent or manipulate any Platform feature, algorithm, or access control.
• Using the Platform to facilitate illegal activities of any kind.
• Creating multiple accounts for the purpose of evading a suspension or ban.
• Using another Creator’s identity, photos, or stats as your own.

Violation of these rules may result in immediate account suspension or termination without notice.

16. Termination

We reserve the right to suspend, restrict, or terminate your account and access to the Platform at any time, with or without notice, for any reason, including but not limited to:

• Breach of these Terms.
• Conduct that we reasonably believe is harmful to other Users, third parties, or Pickle.
• Extended periods of inactivity.
• Legal or regulatory requirements.

You may deactivate your account at any time through the Platform settings or by contacting us. Upon termination, your right to use the Platform ceases immediately. We may retain certain data as required by law or as described in our Privacy Policy and Data Deletion Policy.

17. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. Pickle does not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information on the Platform. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Pickle and its directors, employees, partners, agents, and affiliates shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or business opportunities.
• Damages arising from your reliance on any content or information on the Platform.
• Disputes between Creators and Brands.
• Unauthorised access to or alteration of your data by third parties.
• Interruptions or cessation of the Platform for any reason.

In no event shall Pickle’s total liability to you exceed the greater of (a) the amount you paid Pickle in the 3 months preceding the claim, or (b) INR 1,000.

19. Indemnification

You agree to defend, indemnify, and hold harmless Pickle and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgements, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to: (a) your violation of these Terms; (b) your Content; (c) your use of the Platform; (d) your violation of any third-party rights, including intellectual property or privacy rights; or (e) any collaboration arrangement between you and another User.

20. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last Updated” date. For significant changes, we may also send an email notification to your registered address. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.

21. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or in connection with these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.

You agree to first attempt to resolve any dispute informally by contacting us at contact@pickle.live. We will make reasonable efforts to resolve disputes amicably within 30 days of receiving your complaint.
